Form 1099-MISC 2015

Received first Form 1099-MISC 2015 for Indian Gaming Casino with disclosure attachment: For all 1040s completed for Minors with at least one living parent as of December 31st of the Tax Year, Box 6(d) must be "o" and Form 8615 must be attached, as the income is subject to "Kiddie Tax". The IRS will take exception to all tax returns for Minors without Form 8615 attached...what does this comment suggest to you in preparing this child's Form

It doesn't suggest anything to me. You complete the 1040 for the minor as usual. You complete at least Part I of Form 8615 and attach it to the child's return. Standard operating procedure.

How could this 1099 be for a child? Isn't it illegal for minors to gamble in casinos?

Gambling winnings are reported on W-2G, not 1099-MISC. 1099-MISC could be for non-employee services provided by the child, s prize, or for one of the other, less common items reported on this form.

It's probably a tribal per capita distribution of gaming proceeds. That would be one of the less common items reported on Form 1099-MISC.

"Reporting of Per Capita Distributions by Tribal Members" "Due to return processing delays relating to the erroneous assertion of self-employment tax on per capita distributions to tribal members, the Service has developed a solution which involves wording that must be entered on Line 21 of Form 1040."
