2008 Stimulus Payment?

Nov 17, 2010 1 Replies

My mother-in-law has not filed a tax return since 2006 (and is not required to file because of low income). She did not file for 2007 nor receive the $300 stimulus payment.

Is that payment still available by filing a 2007 return late? Would payment be issued automatically or do we need to claim a refund on 2008 return?

What is proper procedure at this time, if any?

She needs to file only a 2008 return. That return will indicate that she didn't receive the advance payment based on a 2007 return, and the

2008 return will produce the refundable credit.
