Disabled adult dependent and SS

My daughter just turned 19 and is now currently receiving disability SS. Couple of questions.

  1. Where would I declare her SSI income since it is payment to my wife on my daughters behalf? Thus according to Social security my wife is the guardian of my daughter. a. Would this go on our Joint Return or would my dependent daughter need file a separate return.

  1. Since she is dependent would she qualify for EIC? Child Tax credit? She is also still attending program through high school that provides employment with no wage. It is being administered through the local school district here.

Thanks George Holmes

Neither, assuming it's your daughter's only income. First, it's your daughter's income, the 1099 will be under her SSN, and it doesn't go on her guardian's return.

If it's SSI it's tax-exempt. If it's SSDI, it's subject to the same rules as SS retirement benefits in determining the taxable portion. In no case does it contribute to determining a filing requirement.

She remains a qualifying child for EIC. She's been too old for the Child Tax credit (under 17) for a couple of years already.
