HSA and exchanges

I can't find any policies on my state exchange that specifically say they are HSA-eligible. Is there something to the policy that makes HSA-OK or is just meeting the deductible minimum and out of pocket maximum?

None of the policies on the NY state exchange are HSA eligible. But my carrier has policies on its own site that look identical, and many of them are HSA eligible.

This may be a quirk of the way that the ACA works, or it may mean that you can have an HSA, or you can qualify for ACA subsidies, but you can't do both.

If a plan is a qualifying High Ddeductible plan, the insurance company is required to make that statement in the policy (This is a Qualifying High Deductible Health Plan) or they must include a statement that says the policy meets the requirements of code section 223. Generally, the insurance companies either package the HD plans eligible for an HSA separately from the other plans or they put the letters HSA somewhere in the plan name.

You can find the definition of an HDHP (hi ded. health plan) on pages 3 and 4 of IRS Pub 969.

Excellus' Bronze ('select' & 'standard'), and Silver 'select', all say they're HSA-eligible. (From the exchange.) I'm in CNY, if that might matter.

By coincidence, I also happen to be an Excellus customer in CNY, and I could swear that when I looked at the exchange last month, it didn't say anything about HSA eligible. It definitely does now. Odd.
