NYS tax, itemized versus standard deduction

Dec 01, 2018 1 Replies

Instructions for IT-201 say that if we use Federal standard deduction we must use New York standard deduction. This year it's not a problem for me, but in tax year 2019 it will be: I won't have nearly enough Federal deductions to itemize, but my deductions will be well above the state standard deduction.

Does anybody know if the legislature plans to relax that rule? I know there have been other changes to mitigate the ill effects of the 2017 tax bill on NYS taxpayers.

Starting in 2018 New York will allow you to itemize deductions on your New York tax return even if you claim the standard deduction on your federal tax return. This is covered in the 2018 instructions for Form IT-201.
