Roth and filing separately

I just queried (at this late date) the IRS about setting up a Roth for '05. To my amazement, they said since I and my wife filed separately, I cannot to that. (I/m over 65, self employed still working-consultant) AJC

You'll be happy to know that the federal government does not discriminate based on age, but rather because of your filing status, it's your income that is over 10,000$ which prohibits the ROTH contribution. Not fair, I agree. I even take issue with all the favoritism shown to joint return filers. To my mind, each PERSON should file his own return and be subject to same laws as every other PERSON. But then, I'm not in congress.

I don't know what they actually said, but what they should have said is: If you file separately and you lived with your wife for any period of time in 2005, then your MAGI would have to be less than $10000 to make a contribution. If you did not live with your spouse, then your MAGI must be less than $110,000.
