Tax Question

Our daughter who is a student living at home earned $4000. Can she be claimed as an exemption. I know the "relative" limit is $3200 but she is a dependent.

Yes! you can claim her as dependent and take exemption of 3200, if she is over 18 but under 21 and a full time student you can claim her as dependent.

If she files her income tax she can only take 800 as exemption.

Thanks so much for the response She is 23, does she not qualify because of her age? I can't find this in the code so apreciate it!

Clarification: If she is under 24 and a full time student then she can be claimed as a dependent.

That is not correct. Section 151(c)(1)(B)(ii) of the tax code clearly states:

"(c)(1) An exemption of the exemption amount for each dependent (as defined in section 152) - ... (B) who is a child of the taxpayer and who (ii) is a student who has not attained the age of 24 at the close of such calendar year."

Hope this helps. John R. Jorgensen
