American Opportunity Credit, 5th year student

Feb 24, 2012 1 Replies

New client has daughter that graduated from high school in 2007 and started college in August of the same year.

Past tax returns that show a Hope/AOC taken for his daughter in 2007, 2008, and

2009. However in 2010 the Lifetime Learning Credit was taken.

The daughter was a 5th year senior in 2011. Can the taxpayer take the AOC for qualified expenses paid in 2011?

Yes, for QEE paid in 2011 for an academic period beginning before April 1 2012.
