Filing an amended return for 2008

I run a side-business that earns around $40k/year. I started contributing ~$7k/year to a SEP IRA since 2008. Unfortunately, I didn't realize SEP contributions are deductible. So I need to file an amended 2008 return. Are my steps below correct:

Download 2008 1040 and fill out first two pages with new info. Fill out 1040X

My understanding is my taxable income will decrease by $7k so should expect around $1500 back from the IRS. Or will anything else also change that I may be overlooking? Should I file an amended state return also?

Do not attach form 1040 to your 1040X, but do attach changed forms and schedules.

Include exactly what you ae doing in your explanation of changes.

If you have made the mistakes described in your two messages, it is very possible you have other corrections to make especially on your schedule C. It might be helpful to seek local professional tax assistance.

That seems right, as page 1 of 1040 is the only place where the deductible SEP contribution is recorded. Be aware that if your AGI decreased, then your medical expense deduction will increase (expenses above 7.5% of your AGI are deductible, so if your AGI decreases, more of your medical expenses are deductible), and so on for other things like: misc expenses (subject to 2% of AGI), itemized deduction phaseout (will be less), AMT phase out (will be less), making work pay credit might become available if it previously was not or it might be more (it is phased out from 75k to 95k). Are you using software?

You should file an amended state return if you get back more than $25. If you get back less than $25, then it's questionable whether the work is worth it. If you're using software, it will be easy to do.

You need an amended return for 2009 as well if you already filed it.

Will my SE tax also change since that is based on my taxable income, correct? I am using 1040.com to file . I don't believe I can change things online from past returns. But the changes seem simple enough I can do by hand.

FIrst, I repeat my strong advice not to attach a 1040 to the 1040X.

If the reason you are amending is to include $xxxx of SEP contribution on Form 1040 line 28. then say just that in your 1040X Explanation. But don't submit a 1040.

If other forms and schedules change because AGI was decreased, you could either attach a changed form or schedule, or just reference those forms/schedule changes in your explanation.

I doubt that changing your AGI by increasing the above-the-line deduction will have any effect either on your schedule C or SE.

Check if you can use 1040.com to do amended returns for free. Your SE tax won't change.
