how to get back social security taxes in claim of right

Suppose you were overpaid wages 5k. You recompute your return without the 5k income and claim the reduction in federal tax as a credit. How can you recoup the social security and medicare tax that was withheld?

You must be asking about someone who has separated from service and had to make the repayment to a former employer. You ask the employer for a statement indicating the amount repaid and the amount of employment taxes that were originally withheld. This statement is your support for completing Line 7 of IRS Form 843 seeking a refund. If you can't get a statement then you will have to use whatever evidence you have regarding the overpayment you repaid.

You seek a refund from the employer that withheld the FICA taxes.

You can only claim a credit on your income tax return for overpaid FICA taxes if you worked for two or more employers and the combined FICA taxes withheld exceeded $7,049.40 (the maximum due from a worker for

2013).
