Retirement and Minimum Required Distribution - a Question

I am pretty sure of the answer, but want to make sure by asking the folks here.



If a person (over the age of 65) officially retired from a full-time job on



12/31/2008, this means that he/she does NOT have to do a "Required Minimum Distribution" in 2009 on their 401K or their annuity? Only in 2010 - correct?

The "over age 65" comment in your post has no relevance when it comes to RMDs. RMDs commence when you turn age 70 1/2 or if you are still working for that employer when you retire or terminate your employment.

Either way, for tax year 2009, anyone with a 401(k) plan that is required to take an RMD may choose to suspend that distribution. In other words, they are not required to take a distribution in 2009.

Better to phrase that "they are not required to take a distribution FOR

2009."

In a followup on the unmoderated board we learned that the retiree was 78 upon a 12/31/2008 retirement. That means an RMD for 2008 is required by

4/1/2009. The legislation suspending RMD's for 2009 did not affect 2008 RMD's that weren't taken in 2008.

Probably better to say: If 2009 is your RMD distribution year, you are not required to take your 2009 RMD. If 2008 was your fist distribution year and you are delaying your 2008 RMD to no later than 4/1/09, you are still required to take that RMD.
