Sale of condo, costs

Jun 28, 2010 6 Replies

I made a trip from PA to FL exclusively to sign papers for the sale of my condo and remove personal property from the condo. Can I charge to cost of the trip as an expense against capital gains (or something else)?

Assuming this was personal-use property, no.

Even if he sold it at a profit? Signing the papers is a required step in the sale, so maybe there's a partial amount allowable as an expense of sale....

As for the removal of property, if it doesn't qualify as a moving expense, then I agree - no amount allowable.

I've had to remove property from an apartment in order to make the sale, because the buyer insisted. The cost of removal (in this case, I paid one of the building workers to do it) was considered a cost of selling.

I've sold real estate in DC, IL and KS and didn't have to be present at any of the closings. If there was no way to complete the sale without OP's physical presence then I'd say yes, it's an expense of sale.

What if completing the sale without his presence required hiring an attorney at a higher cost than traveling himself?

We could play "What if?" until I have to start prepping for next year's training, and the heat finally broke here, so I'm dropping out after this round. I believe our friends "reasonable and necessary" would have some importance.

Bye now.
