Virginia taxes??

Taxpayer and spouse are residents of North Carolina since October 2003. Two questions.

  1. Spouse received Form 1099-R from Virginia Retirement System. Taxable income and State tax boxes 2, 10, 11 and 12 are as follows: 2. Taxable amount 40
  2. State Tax withheld 0
  3. State/Payers state no. VA-0014212558
  4. State distribution is blank.

Is the above amount considered Virginia source income or taxable income to Virginia? Should VRS be told to update records so box 11 shows NC taxable income? Second question. Taxpayers own rental house in Virginia. Schedule E line 22 of Federal form shows taxable income of $312. Assuming the VRS income is only taxable in North Carolina, is there a filing requirement in VA?

No. Box 11 is simply the payor's state ID number. There's nothing wrong with the 1099, and the income is not VA taxable income.

Check the instructions for the nonresident VA form.
