w-8 ben question

i read online that the irs requires me to file it because i'm a foreign investor. but my stockbroker didn't tell me to file w-8 ben. i owned mutual funds in 2007.



since i didn't file w-8 ben, will i get in trouble with IRS? is this considered fraud?


Fraud is not a problem but IRS may direct your broker to impose backup withholding on your investment income if you do not furnish them a Form W-8BEN.
