bancruptcy and issues of debt

Hi there

I am looking for information concerning options etc for a person who owes money in Britain, however is presently expat in another country.

The person in question has left UK for now and is resident elsewhere. When he left the country he has debts to a trading bank and also the Inland revenue for unpaid taxes to date. The total amount owed is less than 15,000 pounds.

He is presently unemployed, however it has always been his intention to repay outstanding amounts as and when work permits him to earn enough money to do so. This period of unemployment is likely to be short term rather than long term.

Without looking for what he should do 'ethically' I would appreciate knowing what lies ahead, and how it is likely to be dealt with in the short term.

Can a person offshore be declared bankrupt in his absence

Can he file for bankruptcy himself, if so what are the long term implications should he ever return to England.

Can the creditors take action even if he is abroad, (he has no assets in UK, in fact has none abroad either). Do they have jurisdiction abroad.

I appraciate that this nis a wide question, but would appreciate some help in seeing what his options are.

I heard that a court action cannot be enforced if it happens while someone is abroad. This is probably just for civil or magistrates courts.

Yes. It will remain on file for 6 years, and until he is discharged it will be a criminal offence to apply for or accept credit without informing them that he is bankrupt.

It may be better to file in the country he is in at the moment, especially if that country is called USA. Depends on the rules in that country.

Yes, but they won't get very far in collecting any money.
