Hmmm. I would have thought that a nicer solution would have been to just treat the excess as a 2008 Roth IRA contribution instead. That would have left things in place and given an extra year for the assets to appreciate. Since this was after Jan. 1, 2008 an IRA contribution for 2008 is certainly allowed (unless of course, you may end up not being eligible to contribute in 2008).
