Sophy tax case re unmarried couple and mortgage debt.

Law360, New York (August 7, 2015, 7:12 PM ET) -- The Ninth Circuit, in a 2-1 decision Friday, said an unmarried couple who jointly own homes are not subject to the interest deduction limits for married couples and can each take the full deduction on interest of up to $1.1 million of mortgage debt.

The panel in an issue of first impression reversed a decision of the U.S. Tax Court, which said unmarried California domestic partners Bruce H. Voss and Charles J. Sophy, who co-own two homes as joint tenants, can each take the deduction on...
