Travel expenses on a law suit tax deductible?

Aug 12, 2019 2 Replies

My daughter in law lives in WI and was rear ended in WA. She hired a lawyer and had to travel there to meet with him. Would her travel expenses be tax deductible?

I suspect not, as her payments will not be taxable, but you never know.

Thanks.

Your intuition is correct.

Even if the payment was taxable there would not be a deduction as the

2017 tax act eliminated (at least thru 2025) the ability to deduct miscellaneous expenses subject to the 2% of AGI limitation.
