Expat income declaration to UK IR.

Looking for advice....

British citizen. Worked in the UK from Aug 04 to Jul05. Prior to that worked abroad in East Asia for 5 years.

Left UK in Jul 05 permanently. Now trying to claim tax back for period Apr05 to Jul 05.

Tax office sent request for overseas earnings for Apr04 to Aug04.

Why is this when my claim is for Apr05 to Jul05? Concerned because when I completed my tax credits form in Sep 04, I gave my UK income as zero for the year before - wasn't asked about the overseas income on the tax credit form.

Also, is there a risk by under-reporting in this case?

Oct 05 is a little early for determining your 05/06 tax liability isn't it? How can you possibly know you "Left UK in Jul 05 permanently"?

Presumably, because the period Aug04-Mar05 is more than

181? days and this makes you UK resident for TY 04/05 and theoretically subject to tax on your world-wide income for this period.

AIUI, you can claim split-year treatment for the first part of the year when you weren't actually resident but you have to apply for this status by filling in the relevent section on the Tax return and as you haven't done this, the Tax office want to tax you on it.

You do this on the 04/05 Tax Return which isn't due for return until Jan 06. You need the non resident extra pages (as well as the standard bits).
