Litigation, worth it?

Hi All,

This is a follow-up to my earlier post. Basically last year I paid to do one of these training courses where you just turn up when you want and can complete the modules as and when. I attended I think about 4 of the modules (there were about 10 in total). Early in June this year I received a letter from the company saying they had become insolvent and had ceased trading, and I'd be notified if/when a receiver gets appointed. Yesterday I checked with Companies House and the company hasn't filed for insolvency or anything, it is still active! My question is what can I do about this?, can I sue the individuals?. Contacting a local solicitor wasn't particularly helpful , "It's a tricky one" was their response i.e. not optimistic. Any advice/information/guidance much appreciated - I ain't going to let them get away with it!!

If over 100 and paid by credit card, you may have some redress from the cc company?

Well Companies House simply state the company as 'active' - exactly what that means as a status I'm not sure. But their letters say insolvent and ceased trading...........

What they have said may well be true but the company may not have been put into receivership or liquidation or anything like that.

They update very regularly. They may not have anything to update. Mark may have been told anything but unless Companies House is given information there is nothing to update.

The company can be insolvent and ceased trading but that wouldnt stop the company being in existence - and therefore "active" in Companies House terminology - if neither the directors or creditors do anything.

I think what Companies House mean by "active" (and remember this is a government department) is that the file is still active in the sense they are expecting to receive accounts, annual returns etc for it. In other words, no steps voluntary or otherwise have been taken to have the company removed from the register.

In my experience, Companies House are swift to update their database - within a matter of days of receiving relevant documentation but no documentation - no update.
