mis-sold pension - still no redress!

Aug 07, 2006 7 Replies

I was mis-sold a pension by Mandrake Associates of Wisbech Cambs UK who have admitted liability but haved continually stalled on payment. Ongoing since 1999. Is there anyone else having problems with this company?

Do you have the amount that they need to pay you to put you back in the situation you would have been ?

Yes... I have been advised of the redress amount due on several occasions. Each time I have accepted the figure offered, but they repeatedly fail to pay. Are you in same situation with this company?

No. I asked because if you have such independent evidence then you should simply sue them for that amount, just as you would with anyone else that owes you money. Why let them mess you around - your the one with the law on their side.

What *independent* evidence? She only said she had the offers from the "misselling IFA"...

Those offers are usually made "without admitting any liability". Also, they can usually be withdrawn before payment.

So she's need to fight her case in court, proving that misselling *did* occur...

Which law were you thinking about?

Anyway, I think she'd be better off taking it first to the FOS (Financial Ombudsman Service).

as far as I am aware any redress payment would be by way of increasing the value of the pension, not by a direct payment to the claimant. what was the nature of the 'mis-sell'?

I have been through the Financial Ombudsman who ruled in my favour.. the company was ordered to pay redress amount directly into my pension fund within 28days. They have continually ignored the ombudsman s decision and the Financial Services Authority are now monitoring them.Court action appears the only solution, but I understand from press reports that the company in question have ignored many other claimants/FO decisions in the past. I'm interested to hear from anyone else who may have been in same situation and who may have taken legal action.

This is bad, I hope the FSA & FOS can sort it for you.
