What is the actual uk law on swiss accounts ?

I saw the site below in a uk national newspaper and i was orginally interested in their swiss account in particular BUT it all just seems too good be true.It says they do not declare anything to any authority but surely the uk taxman can soon find whatever info he wants,can he not ?

The Swiss banks do have secret accounts. They pay no interest. Swiss bank charges are heavy. All the details they have will be disclosed to the authorities if there is suspicion that the contents are the proceeds of crime or money laundering. It just needs a court order.

There are two kinds of Swiss accounts. A domestic Swiss account in Swiss francs, subject to 35% withholding tax (impôt anticipé) that, under the tax treaty, you get back only by filing Form 86 (which you get from your Swiss payor) with the Inland Revenue. In my experience, the Inland Revenue has seen so few of these forms that they don't know what to do with them, and the instructions on the tax return tell you, on the contrary, to pay the UK tax and just claim a refund from the foreign tax authority (wrong, in the case of Switzerland).

Those who don't like paying tax get a different sort of account. The Swiss bank acts as broker and lends the money, usually on 30-day terms, in whatever currency you specify, in the Antwerp or Luxembourg (for example) market. There is no withholding and no reporting.

"Secret" accounts are rarely advisable. They attract attention. It is true that under know-your-customer anti-money-laundering rules the signatory has to be known and identified (and never mind if you've had the account already for 40 years: I have had this experience both in the UK and in Switzerland). But putting the funds in a corporate (or Isle of Man LLC, or Panamanian bearer-share company) is probably better.
