1098-T form for person who recently received a greencard

Hi, So my husband was a 'non-resident alien' status while he was a grad student during the 2010 tax year. He married me ( I am a US citizen) in june of 2010. And, he graduated his master's program in May of 2010.



We are now trying to file taxes, and we are filing jointly as a married couple, thru turbo tax.



His college for grad school did not issue him a 1098-T form because at the time his status was " non-resident alien" ,



Now we are just wondering if we should request a 1098-T form for his tuition? Or just ignore this because he isn't eligible?



I would appreciate any advice possible, thanks in advance!


Since through the joint return he's electing to be taxed as a resident alien for the entire year you qualify for the Lifetime Learning Credit or Tuition/Fees adjutment to income. You don't need a 1098-T, just use your records. See Publication 970.
