1099 without having a social security number

My sister is a lawyer and she had her own practice. She paid somebody $ 4000.00 to do some appraisal work in connection with the business. She didn't sign any contract with this person and did not ask for his social security number. He didn't do the work and is refusing to provide his social security number to my sister.

She didn't withheld 28% from the payment. She knows that she has to issue 1099 to this person at the end of the year. How does she issue the 1099 without the social security number? She has his name and address.

Why does she need to issue a 1099? She paid a fee for a service, but the service was not performed, so now she should either get her fee back or take him to court. Isn't $4000 small enough for small claims court?

For the future, if you expect to issue a 1099, then you pay nothing until after you get the recipient's EIN, TIN, or SSN, as appropriate. Una

Something's wrong with the story at this point. If he didn't do the work, why did she pay him? If she paid him in advance and he didn't do the work, why isn't she suing him?

I'm going to assume that she did pay him and isn't getting it back.

Pen & ink or, if she can find one, a typewriter, and she must acquire the forms from the IRS or a business supply place. Copies of downloaded forms aren't acceptible.

She provides what information she has and hopes for the best. She also files away in her memory bank the fact that she lost her leverage when she cut the check and won't make that mistake again.
