Bankruptcy

My girlfriend who lives with me is considering voluntary bankruptcy.

Will this have any impact on my home or circumstances ? My house is solely in my name, and she has been living here for 14 months.

We have no joint finances at all, in escence financially we are seperate entities ?

If it can be established that she has a share in the house (even if the deeds and mortgage are in your name), then yes. If there is another option it's probably better than bancrupcy.

She should think carefully about such a course of action.

In the past, it would have meant it was almost impossible to get a mortgage. Nowadays, it just means that the rate will be loaded.

Check that she has not acquired any legal "interest" in your property.

An IVA is a possible option. Has she spoken to her local CAB?

I'd agree with all the other posts - but one thing to be aware of - if she does go bankrupt you will likely have the baliffs around and they take every luxury good for which you don't have a reciept....

IVA much better...

That could be classed as theft...

There is an excellent forum for debt issues here -

- TMF dealing with debt board. Many of the people have been there, done that, & got the T-shirt, so the advice is from people who have a detailed knowledge of the subject. Best of luck
