Bankruptcy

Can a bankruptcy order can be enforced without the debtor receiving the bankrutcy order in person?

In other words, if the bankruptcy notice was not served personally, is it still valid? What if that person was abroad and was unaware of the procedings against them?

Yes. If the petitioning creditor is unable to have the petition served upon the debtor personally he can apply to the court for substituted service. This usually takes the form of advertising the issue of the application for a petition in one national newspaper likely to be read by the debtor and one local paper circulating in the area where he previously lived. Such substituted service is deemed to be as effective as if served personally on the debtor.

I should perhaps add that it is possible to apply to have a bankruptcy petition set aside but this is a difficult and expensive process requiring the expertise of an Insolvency Practitioner.
