can you insist on your salary being paid to you in cash?

I ask this because I'm finding it impossible to get a simple bank account, just because I don't have suitable proof of my address (they insist on utility bills, but since all utilities are paid by my landlord, that isn't possible).

I'm worried that if I land a job, I won't be able to cash my salary cheques.

Probably written in terms and conditions of service. The Halifax do a basic account- Cardcash, which doesn't have overdraft facilities or any other add-ons. DaveK.

I had a similar problem where all my bills were included, I don't have a driving licence or a passport.

They do seem prepared to negotiate over what they will accept once they know there will be a regular salary paid into the account though (at least that has been my experience).

It used to be (and may still be) part of the Factories Act that they must pay you in legal tender. This is prominently displayed on the wall somewhere in every 'factory' I've been in. A cheque is not legal tender, so I can't see a problem - except that they might decide you are a trouble-maker and sack you :-) On the other hand, if you are really useful, they'll pay you in thrupenny stamps if that's what you want. Personally, I would not worry about it (but then I'm useful ).

Perhaps the bank may accept a copy of your tenancy agreement, as that will state your name and address. It's also relatively good proof that you're going to be in the property at least until the date specified.

No, you can no longer insist on being paid in cash. The Truck Acts were repealed some years ago.

It was the passing of the Wages Act 1986 that removed the right to be paid in coin of the realm, effectively repealing the several Truck Acts in this and other areas.

It was in the Truck Acts, not the Factories Act, and they were abolished by the Payment of Wages Act 1991.

The Factories Act was largely repealed by the Health and Safety at Work etc Act 1974 and these days the notices are for the latter.

That was the Truck Act, IIRC, and the requirement was that you were paid in coin of the realm. The origins lay in the payment in company tokens, only redeemable at the Company Store, which charged unrealistic prices.

I think that it has been repealed, and maybe replaced by a clause in a Factories Act, to legalise payment by cheque or direct into a bank account.

The Payment of Wages Act 1991, allows payment by several methods, so you can no longer insist on payment in cash. However, a lot of employers will be willing to pay you in any legal way that suits you and cash is still one of the legal ways to pay wages.

The requirement for proof of address is for money laundering reg - AFAIK all the bank has to do is be satisfied of your address. Could you get a note from someone reputable saying your are Mr Joe bloggs of 1 high st, anytown? JP's, police officers, doctor's, ministers of religion should all be able to satisfy the bank in this regard.

While you landlord may pay, I would imagine that you will get a bill for Council Tax. Also can you not take a letter indicating that you are on the electoral roll etc?

Can't you get your landlord to write a confirmatory letter? Along with your tenancy agreement this may be sufficient.

Does (s)he really pay *all* the utility bills?

Otherwise have you asked the banks what else you could provide that might satisfy them considering your circumstances?

There is no law that says you must have a bank account, therefore if no company will employ you because they will not pay you cash, then you can't work. (surely this against your human rights)

I am expecting to become bankrupt soon.........that should be interesting.!

For a laugh, you might want to suggest the prospective bank manager pays a visit to your home !

Otherwise, as Jason mentioned I'd imagine your tenancy agreement and documentation would suffice.

As far as I can see the Money Laundeering regulations only require proof of identity, not address.
