how to word request for chargeback

Hi

I have a second problem with a cc charge this year and would like to know what right I have to demand a chargeback, if anyone has a suggestion for wording.

The first problem is from a supplier who I bought one years hosting from 3 years ago. I paid once at the start of that years hosting and moved to a differrent host / cancelled it in 2004. They billed me incorrectly in 2004 after the end of the first year and after I emailed back and forth refunded most of that charge. I also wrote to Halifax and asked for a chargeback in the meantime and they issued a further refund (under 1 pound) for the difference which was due maybe to exchange rate losses.

Now they have billed me again and since I no longer have any contact, I just wrote to Halifax asking they issue a chargeback. They replied with an acknowledgement and then another letter enclosing a printout from the hosing suppliers payment folks. Printout with my cc expiration date of 12/04, transaction date 5/05. I wrote a second letter to halifax pointing this out and again informing them this charge was definitely not authorised. They then replied that they have put some sort of hold on that payment and want to know what domain it involved so the company can know this. They invited me to email the company! The message seems to be they will not repay the money unless the host refund it!

I'm not sure without doing (more ) work exactly what domain etc. but this is a charge from a company who I once bought something from 2 years ago. They don't even know the expiry date of my current cc! Do I have any *right* to demand the charge is refunded?

The second problem is a hotel in Calcutta that I booked online. The confirmation email said that the hotel was prepaid. When I arrived at the hotel they said the room was not paid for and I must pay cash. They offerred me rooms with differring prices and I picked one. I paid cash and have a receipt. I emailed the site who did the booking and they have not replied. ccavenue are the payment provider. It has been chaged to my cc and I now need to ask halifax-visa for a refund or chargeback.

Both these problems are only order of 20 quid but both involve 20 quid effectively stolen!

So, any suggestions? (Other than cut the card in two and migrate away from Halifax)?

Also does anyone have a UK cc which will automatically refund a charge that you query (and preferably let you make the complaint online or by email)?

I was surprised to find how hard it was to get a chargeback done. I also f ound that my (very large) building society would only refund the money if t he charging company agreed or, as happened in my case, they failed to respo nd to the BS's request for information. This took a long time.

It was not the case (as I had fondly imagined) that the charging company ha d to produce some evidence that I had agreed to the charge. It seemed to b e that if it was their work against mine they would win.
