Go to court and offer £50/week. There is a chance they will accept it.

I would have thought you could apply for 25% discount as property only has one wage earner over 18 (you), which would reduce it to 564.67 which is only 47.05 per month (only about 10 per week), so it's only 10% of your wages (still a large %, but perhaps manageable).

I cannot speak at the court appearance becuase I do not have a legal defense as to why I've not paid. However, I'll claim Housing benefit and CTB and see what help they offer

No, the court summons clearly states that I cannot attend the summons unless I have a valid legal defense that they have listed...

Here's some general info.

You need to demonstrate that you cannot reasonably pay the amount. You will get a statement of means form (similar to this ) prior to the hearing. They want to see that you're a "can't pay" rather than a "won't pay". As long as you make a reasonable offer *which you can keep to* they'l have little option but to accept. It's important (and unnecessary) not to make an offer you can't keep to as this will escalate the situation and bring in the bailiffs to take goods away. bailiffs then add high charges on to the debt.

See Citizens Advice - they may be able to represent you for free.

Post on uk.legal.moderated as lawyers & judges familiar with the procedure will be able to tell you what happens.

Why can't you just MAKE the other two pay their fair share. Even the 17 year old should pay a share. It's not as if he's living under his parent's roof. If he wants to live like an adult, then make him pay his fair share. Failing that, boot them out of the house and get some new lodgers. (i'm presuming that the reason only you are summonsed is that your name is on the lease ??)

Really - if there's three of you living there, you should split the bill three ways.

The ones listed are...

- the amount has been paid in full

-the debtor is not the person names on the summons

- bankrupcy proceedings have already been instituted

- and administration order (including this debt) has been made by the county court

- the defendant is unable to payu becuase of relevant service under the Aux Forces act 1951

- the summons includes an amounr which refers to a penalty and the penalty is subject to an appeal

-the liable person in a diplomat and is exempt from paying any local taxes becuase of international law

- the amount has not been demanded in accordance with statuary provisions

All three names are on the list. As far the council are concerned, the 17yo doesn't exist, as he is not liable at his age. It looks like I'll have to pay on behalf of the other housemate and then get the money off him somehow.

Well - hold on a minute - if there are multiple names on the list, why is it only you getting summonsed ? Surely you should get in touch with the council and tell them there is another adult in the house who is responsible for a share.

As for the 17 year old - take him outside and give him a good kicking if he wants to live like an adult but not contribute to the household.
