There is a unit set up to deal with underpayment of the national wage. Report it to them and they should be able to keep your name out of it.

There is provision in the NMW act for this to always be an unfair dismissal (that doesn't mean that the employer won't do this though)

This is not really an option open to the employer.

it will be backdated. The law has just been changed so that enforcement action can be taken against the employer after you have left if you don't want to take the chance on option (1)

IANAL - That means your on the minimum as specified by the Employment Acts

Check your understanding is correct, I believe there are different rates depending upon age. Could be breach of contract as well.

This could well be unfair dismissal, but proving it, and the fact that you haven't been there long are the difficulties.

Potentially unlawful - take them to court/report them to the people who enforce these things.

Not uncommon.

Post on uk.legal as it's more a legal issue. Investigate legal insurance (but don't tell them about this issue!) Don't mention it to your employer until you've got a plan of action (softly, softly catchee monkey!) Talk to some free helplines and read up on basic employment law, links here -
