Another case of poor tax planning

Taxpayer is the son of a US Army deserter and a Canadian mother. At 13, he moved in with his paternal grandparents and went to high school and college in the States. But never filed for citizenship - just used his Canadian status to get by.

He graduated from college last June and went to work for his uncle. Now in mid-March, he and his uncle just realized he needs an SSN.

My response to his uncle (my cousin) was "You aren't stupid so how did you let this drag out so long". You do not want to read his lame-brain response.

What does the kid do?

He could obtain a TN-1 visa (NAFTA Free Trade Professional). All he needs is a Canadian passport or birth certificate and proof from his employer he qualifies under Schedule 2 of NAFTA. They are good for a year with unlimited numbers of renewals. Once he has a DHS document showing his immigration status he can file the SS-5 to get an SS#.
