NYS' eFile Mandate

According to NYS' web site:

Partnerships must e-file if they meet all three of these conditions: Prepare tax documents themselves, without the assistance of a tax professional; Use approved e-file tax software to prepare their return or extension; and Have broadband internet access

Corporations must e-file if they meet all three of these conditions:

  1. Prepare tax documents themselves, without the assistance of a tax professional;

  1. Use approved e-file tax software to prepare their return, or use a computer to prepare, document or calculate an extension or estimated tax payment; and

  2. Have broadband internet access.

I have a small C corp; and I use spreadsheets to keep my corporate books, compute payrolls, etc. For 2011, there is no estimated tax payments. Does this mean I do NOT meet condition #2? Is condition #2 limited to using a computer related to "extension or estimated tax payment" and nothing else? [I meet conditions 1 and 3; and I was planning to do my NYS & NYC Corp tax returns manually.]

If I meet condition #2, doesn't that basically catches all small corporations that file their own tax returns [I don't know how many small corporations are running their business without a PC and broadband internet.]

And if I must eFile, are there any free eFile software for corporations?

If you are not using software to prepare your return you are not mandated to e-file the return. You are preparing it manually, so #2 does not fit your situation.

I would agree with this is the way to handle it, but the way it is worded means if you use a spreadsheet or accounting program (like Quicken) to record your estimated payments (i.e. "document") then you qualify. Ridiculous, yes, so I would take your approach.

What they are trying to do, from how I see it, is if you bought tax preparation software, use it to e-file the return. I agree the wording is a little off.

The logical disjunction is true if at least one of the statements is true. So condition 2 is satisfied if he only uses computer for an extension or estimated payment but does not use an approved e-file tax software to prepare the return. It is not clear how he is meant to e- file a return not prepared on a computer, but this is what it says. (To further complicate things, what if you only use a computer to calculate that you do not have to make any estimated payments, can this force you to e-file?)
