Marks & Spencer car insurance

I have had motor insurance with Marks & Spencer for several years with no claim. Now I have just had to put in a claim for slight damage done when the car was parked and nobody in it. The third party kindly left their name, address and insurance company on a note apologising for the damage. This was all forwarded to Marks & Spencer who gave me instructions on proceedures to get the car fixed. Out of the blue, came a recorded delivery aggresive letter from Marks & Spencer cancelling my insurance demanding the cover note and policy back. Anyone else out there had this done to them. This now means I have been blacklisted, when another insurance company asks if I have been refused insurance, I have to say yes. All this for one claim where the third party has admitted liability and all details have been given to Marks and Spencer. I have not claimed from Marks & Spencer before. I went to Marks because I thought I would get a decent service, I was not after cheap insurance. I have telephoned them but talking to a brick wall is easier.

Any thoughts please.

My thoughts are that you are giving us only half a story.

An insurance contract is binding on both sides. It is not open to the insurer to cancel your insurance unilaterally unless you have breached a policy term or have failed to give full disclosure of your insurance history.

If you can explain why they cancelled your insurance maybe someone could offer constructive suggestions. Failing that, one can only conclude that they had you bang to rights and that you are trying to get your revenge by tarnishing the good name of Marks and Spencer who make exceedingly good cakes.

It's all the story. No information has been held back. No previous claims, clean licence and always has been, standard car, ordinary car (Ford Focus), I'm afraid I cannot give any reason why the insurance has been cancelled, Marks will not tell me. I have no reason to tarnish Marks and Sparks, I have other insurance with them and several finance packages which have served me well.

Not sure about the cakes though.

If you can quote the full text of their letter cancelling the policy, it might be possible for some of us to explain what they are talking about. The egg and prawn rolls, incidentally, are even better than the cakes.

If the facts are as you state, eg there is nothing 'naughty' about your insurance, they must have have screwed up internally, and I would go to a solicitor, since you may have a claim for some sort of damages since your are effectively being libelled/slandered etc as far as other insurers go for no good reason. Though before that there must be an arbitration service you can use?

Is there something about your insurance you arent telling us? If not, a cockup at M&S seems likely. What actually happens when you call them? Do they refuse to speak to you?

Weren't M&S involved in a case a bit back whereby a woman was banned for life from all their stores in the country and they declined to give a reason why. Something to do with taking a pair of shoes back.

Maybe the same customer service rep is dealing with you.

Maybe it's their policy to treat people that way?

Maybe they've got you mixed up with someone else. Did you, or anyone of your aquaintance, ever take a pair of shoes back to M&S? ;-)

Maybe... I know someone who recently bought a suit and washed it as per instructions and now it wont' iron properly - they've been told it is because its "They have refused a refund on the basis that many of the fashionable clothes purchased now are just especially prone to creasing. "

In all probability, some insurance company offers insurance under the Marks Sparks moniker, and pays them for the privilege. If you cannot get satisfaction, then start leaning on Marks & Sparks general management, their insurance 'partner' is not supposed to cause them hassle.

All sorted now thanks. After sitting on the phone all day, we spoke to M&S, the M&S Brokers and Zurich who supply the insurance. None of them knew why the cancellation went out but agreed that it should not have. Anyway, now settled, I have insurance for the next year, the cancellation has been, well, cancelled and my 'no claims' is intact. When it is up for renewal, I think I will have to look a bit closer at the integrity of the supplier although this hiccup is no reason why I shouldn't go back to Marks & Sparks again. After all, they did listen, eventually, and did something about the problem.

This episode will cost me a treat for my wife who did all the phoning and once she gets her teeth into a problem, will not let go until it has been solved. Maybe Marks knew this.

Now, where's that egg and prawn roll.
