Payment in error

I have just been advised I was receiving a responsibility allowance at work for which I was not entitled and they paid me in error. It relates to the

04/05 year. Can they have it back? It is about 1k in total. I was not aware I was being paid it as I don't look at my pay slips and just check what goes into the bank.

Does the Inland Revenue have to give their bit back as well.

Yes they can have it back. It's reasonable for you to have noticed you were getting it and queried it earlier.

I'd try to negotiate payment in instalments though. If your employer is reasonable he will allow this.

Were you not advised that the allowance was being awarded? Normally employees are notified in writing of such events.

If so then it's yours and you should expect to continue receipt until such time as the responsibly is taken away, i.e. your job becomes easier.

If your employer has totally mucked things up and can demonstrate how the error has occurred then you should agree a repayment schedule, e.g. 50p per month. I doubt if any employer would admit to making a mistake!

Check with your Union representative.
