Quick Question - P45 for last tax year, do I need P46 instead?

Ok started a new job in September after graduating from university. Now I did a gap year in Uni which meant I was earning between 2003 and 2004, I have a P45 for that tax year.

Now do I hand this out of date P45 in or just print a P46 off the internet and hand that in? Searched the tax website and couldn't really find anything that answered my question. HR at work are just about as useless!

If you still have a P45 for a previous year, just hand it in.

The main purpose is to use it to find your tax records.

No - it's irrelevant - other than if you can recover any tax over-paid in that tax-year, in which case you should send it with covering letter direct to HMRC to claim.

No - the employer (not you) should provide P46 and ask you to tick the right box(es) and sign it. Include your NI number.

Your employer should have done this when you started last September. Have you been paid yet? If so, on what basis was tax deducted?

Surprising if HR is in charge of payroll... Go and talk to accounts instead...

Yes I've been paid and am currently on the BR tax rate (Surely I should be on 47..... something?)

I'll get onto them about the P46 then!

It used to be if you started without a P45 you would go on a single person code on an emergency basis. BR code is not necessarily en emergency code. The issue of the P45 is when you hand it in the new employer can add on the previous pay and tax to their pay to continue the cumulative basis ( assuming there is no gap in the employment ). In a P46 case the new tax office will issue the code once the records are transferred in. This will advise the new employer of the pay and tax ( if any ) from the previous 6 April so they can include it on their payroll. For the present you could call your tax office and ask them if they will issue a new code on a week 1 / month 1 basis which will get you off the BR code while it is being sorted out. If you ask nicely they may even issue the correct code although officially you may have to complete a P91 from confirming the gap in you employment first.

Good. Unless there's something unusual, you'll be ticking boxes A & B on the P46, to say "1st job since leaving Uni" & "only job". Your employer then MUST automatically put you on Emergency Code - i.e 489L - on a cumulative basis. HMRC will subsequently confirm this (or otherwise, if there's something unusual in your case).

So (assuming your numbers are fairly typical for a new graduate) you can expect a tax refund in next pay-slip (but not necessarily all of the tax paid so far).

Also be aware, though, that this will probably be the first time HMRC discover where you are, so any Student Loan repayments may start... :-(

HTH - and don't let your employer fob you off or procrastinate - it's tempting not to make a fuss when you're young and new but, so long as you're courteous, it shouldn't do you any harm to be recognised as someone not to be messed with...
