Self Employment and Employment agency

I have some jobs comming up, and am self employed.

The agency confirm the booking, if I agree to the hours and the rate/ hr.

If I am contracted to be there from 9am to 5pm and I have an hr break, can I still invoice them for 8hrs rather than 7hrs?

At the moment I am putting my invoices through at 7 hrs.

Thanks for you help.

Almost certainly not, but what does your contract say?

Theres nothing mentioned about breaks. When the work is booked, they give me the hours on the phone, but there is no mention for breaks, lunch hr etc.

In which case, you don't get paid for them.

As a self employed contractor, you get paid for the actual hours you are working only, unless your contract says otherwise.

Phone the employment agency and confirm what they are offering you as work, pay and breaks A lot of agencies pay a minimum of 8hrs regardless of shift length.

Easy answer is do you get paid for any overtime if so then your'e paid by the hour excluding breaks.

I've had contracts paid by the day that means no overtime payment but invoicing for a whole day even when taking a couple of hours off.

In my industry (IT) I find no one gives a f**k so long as there's no fiddle going on and the job gets done and it works correctly. In fact, if the job gets done and it works correctly they'll put you in for a knighthood - there's so many chancers around.

The only sort of circumstances where you might get paid for breaks inclusive is if you are stuck on the premises (a.go. working on an oil rig).
