Nebraska Supreme Ct Overturns Appellate Order Forcing A Divorcing Spouse To File Jointly

Robert Steinberg, a tax attorney and CPA writes a blog called The tax Wars. Back in Oct. 2011, he posted an article on the issue of state courts forcing divorcing spouses to sign joint federal returns. At the time, the Nebraska Appeals Ct had upheld a lower court order so ordering. The Nebraska Supreme Ct has tossed that decision. Below is Mr. Steinberg's earlier blog and the followup posted today. They make for interesting reading as they list those states that have so ordered a spouse to sign and those states who have declined. Citations are included.
