Tax ID Number dilemma

****************** We had a LLC in CA. Then in the 2008/09 recession, we closed the LLC with the CA FTB to avoid their large yearly franchise fees. We had no revenues. However, the bank account remained open.

A few years later we had a different business and this time we applied to the IRS for a new tax ID with the same name but without the LLC in the name. It is a partnership ie 1065. The IRS sent us a new tax ID number. However, we neglected to change the tax ID with the Bank so they had the OLD LLC tax number for the LLC.

The amounts in this new business were very small so it was not worth paying the large CA FTB LLC annual fees and we did not need the LLC protection for this tiny business. For a few years now we have been doing our IRS Partnership tax returns (1065) with the new tax ID #. The bank still had the old tax ID #. We used this bank account to make deposits and pay expenses.

Now we have applied for the $10,000 EIDL loan/grant. On the form, we had to mention our tax number. We indicated the NEW tax ID # and the Bank name and account number.

Our fictitious name registration in the County had expired a few years ago. We had not renewed it because we had no revenues in 2008/09 etc and forgot all about this.

To open a new bank account with the new correct tax ID number our bank wants a fictitious statement registration with the new name (ie without the LLC in the name) from the County.

Now, in a bid to make things correct, we went online to do a fictitious search and found that the name we want without the LLC has been taken so we cannot even claim that name and make things right.

Based on the above will we get rejected by the SBA for the EIDL $10,000 loan/grant because the bank account tax ID # is different?
