Alliance & Leicester PPC Misselling

A pensioner neighbour came to see me at the end of last year as she had taken out a credit card with A&L. She had not requested PPC. She obviously, from what she said, later got a hard sell phone call for PPC (Payment Protection Cover) and had finished up with it. She came to ask me what it was!!

I explained - told her it was of no benefit to her whatsoever and to complain to A&L.

I decided to take out credit card - purely to see if same happened to me. I am retired - PPC no use to me whatsoever.

I applied - got the card - and used it - and then I got some literature through post regarding PPC. When I got the bill I had been charged £1.69 for the PPC. I wrote a letter (feigning ignorance) - saying what was this PPC on my bill - I had never requested it.

I received a letter telling me what it was and that I had applied for it when I applied for my card.

I asked for a copy of my application form.

I was sent it - I had not ticked the box requesting it.

I wrote again telling them that they had lied - I was then told I had requested it by telephone on a particular date. I was told that the telephone calls were recorded.

I then sent a subject access data request and ten pounds - telling them that I intended to recover all monies associated with this fiasco via the County Court (not being sure if I could do that or not).

They delayed, and delayed with the SADR data and eventually sent it - they said that the telephone conversation when I had requested it had not been recorded. They provide a log of that call which show PPC added - but no record of me requesting it. They said that they will refund the £1.69 to the credit card account - as a gesture of goodwill. There is no apology. The credit card account was paid off and closed some months ago.

I really want these bastards to suffer; I do not believe that myself and my neighbour are the only ones to have been "conned" into taking out the PPC.

Obviously I can complain to Insurance Ombudsman or FSA - but is there any way I can demand the costs of the SADR plus a charge of say ten pounds letter for me sorting it out - and then take them to court if they refuse to pay?

Or - any other suggestions please?

It still doesn't beat the Barclays Team charging my son 90 for going 5 overdrawn...I am still waiting on the court findings on this one.

You have to exhaust their internal complaints procedure before you take it further. If you go to court without having done that and then asked the regulator to investigate the Cout will take a very dim view. Every case taken to the regulator costs the company at least a hundred pound fee regardless of the outcome.

I once got charged £15 by Barclays for going £1.20 overdrawn. When they did that I told them where to stick their banking services...

They have written to me and told me that the complaint process is exhausted. I will be complaining to the ombudsman - BUT can I take them to court?

Is she a bit funny in the head agreeing to things when she doesn't know what they are. Does she let every salesperson in through her front door and agree to buy everything they offer?

How do you know whether it is of no benefit to her? What financial qualifications do you have to give this advice?

Yes, get your "neighbour" to give you the money. She never asked you to get involved on her behalf, so you are responsible. You are also not able to have a refund of the 10 now.

he like many thousands of others agreed to those charges. Why should a bank be expected to just lend people money when the customer knows they are taking an unauthorised loan?

Just get a life, move on and don't get involved in things that do not concern you in future. That should be the biggest lesson. Your neighbour is probably laughing as she might have been paid for introducing you! I bet you forgot to check how much she was given for introducing a new customer!!!!

Because going 5 pounds overdrawn is the sort of simple mistake that anybody could do when adding up (subtracting) the amount of an intended payment to see if they can afford it. It's hardly likely to be a genuine attempt to "borrow" money.
