Dispute over Mastercard refund.

Hi,

I am trying to resolve a dispute with the customer relations of a firm where an incorrect amount (actually an additional transaction) has been charged to my MasterCard.

This procedure is dragging on. I understand I can just call my bank and ask for the amount to be removed. It sounds simple, but I wonder if it has to happen within a certain period from the disputed transaction. And if it requires a lot of hassle. The amount is only £70 but that?s £70 that should be mine, not the offending company?s!

I'm not sure that you can *necessarily* just call your bank and ask for the amount to be removed. It sounds to me as though that would be a s75 claim, which doesn't apply to purchases of less than £100. See

You say that the matter has been "dragging on" - I'm not aware of any time limits to s75 claims, but there almost certainly are some. If the "dragging on" has taken more than six years, I would expect the credit card issuer to be significantly less sympathetic than if is has taken six weeks.

The only way to be sure is to call up your credit card provider and ask them.

I think with most card companies you have to initiate a chargeback within 90 days (some will be lower at 60) of the amount being debited to your account.

IANAL or finance whiz etc.

Just call the card company and tell them the additional transaction was unauthorised and put the amount in dispute.

IIRC the company then have to provide evidence that the sale was authorised, or suffer the chargeback. The amount will probably stay "on" the statement until this is resolved.

I think there's something like a 40 day period during which time they're supposed to sort out a refund, but if it wasn't authorised in the first place, this shouldn't apply.

How long has it been ?

That s75 provision applies when holding a credit-giver liable for a supplier's performance under a contract. A false charge taken without permission and in the absence of any contract is unrelated to that.
