Money Laundering Regulations

There has been a thread running in uk.legal: ( Is it correct for a Bank to ask you to post them your driving Licence) where the money laundering regulations have been referred to.

There seems to be a view that the Banks have sometimes implemented the requirements on them checking identities in very different ways - and there are some quite stupid examples. It has also been stated that an individual member of bank staff could be fined or imprisoned for not carrying out required checks - even if they were following the bank's procedures.

A few points for discussion Is it prescribed what means of identity banks must seek? Are there any guidelines issued to banks on procedures to be followed? Why do the banks do things so differently? To what extent are individual staff members responsible for failing to "catch" a fake identity?

Does anyone have any pointers to recommended info on these matters.

454 . It's very complicated and wordy and this wordiness is what causes different institutions to interpret the guidance differently. If you were responsible for the anti-money laundering in your institution you might interpret things in a way that made you look like a jobsworth. So you take a more relaxed approach and you end in jail! Rob Graham

It is ironic that at the same companies that are insisting on seeing paper statements as proof of identity, are also pushing their green e-billing schemes upon us.

In fact the only reason I still get paper statements for my utilities is so I have something I don't mind posting if I need proof of ID.

To many people the money laundering regulations seem to have been deliberately designed to make transacting business as awkward as possible. At the same time criminal organisations seem to have no problems laundering their proceeds.

If you aren't happy to send them your driving licence find another bank!
