Salary Paid Into Wrong Account...

My girlfriends salary was due to be paid into her account for the first time on Friday however it did not appear. On calling the bank they confirmed payment had not been received. The company claim that payment was made however following checks with my girlfriend revealed it had gone to a wrong account number (one digit different apparently).

The bank claim there is nothing they can do, the agency say it is her issue with the bank. Because the payment was made between the agency and an unknown party the bank say they cannot even discuss the matter with her in any more detail!

HELP!!! What is the course of action in these cases? All the agency can suggest is that she writes a letter but i can't believe there isn't some form of legal protection for her.

I'd appreciate any advise you can offer.

Sounds an unlikely story; a one digit error would fail the IBAN modulus test and not be a valid account number.

I don't understand the exact problem. Did your girlfriend give the correct account number to her employer? If so then she has simply not been paid and she should tell the personnel department about it and warn them that they are in breach of her contract of employment.

The agency need to pay her. If they havent done so and are using the bank as an excuse this sounds like a dodgy agency.

Who provided the wrong account number? Girlfriend, employer, bank?

If your girlfriend provided the correct number, then she wasn't paid and she has a clear claim. The employer has to recover the money (easily done via the same channel in which it was deposited).

Some years ago my government employer started a new salary payment system. It was still by cheque, but a computer list of all payees (all employees) was given to each bank with which employees had accounts. And one particular bank, Citibank, managed to put all the money, hundreds of thousands, into the first account listed and nothing at all into any of the others. Turned out to be the account of one of the secretaries. Startled, to say the least, by the government's largesse.
