TENANTS RIGHTS

I am staying in a room in London and the rent is 80 pw. I have been there since Feb 2003. It is a big room with an excellent view. Bathroom and kitchen are shared and all in all it is pleasant. My landlord has a property in Cyprus but stays in the spare room in the flat 6 months of the year. There is one other tenant in another room. So I effectively stay in my Landlords house. My brother has been staying with me now for 4 months since Jan 2004 and will probably be here for another 3 months. He had nowhere else to go. If my landlord decided he no longer wanted me there - because of my brother for example - how much notice would he legally be obliged to give me ?

Is your landlord on his way back from Cyprus? If I were you, I would clean everything up super-clean and make it really tidy. Then explain the position your bro is in.

You are probably in breach of your tenancy agreement, so he would not have to give you any notice. Actually getting you out would be harder.

he is here already. he knows about the situation but mentioned it to me last night. as in "how muvh longer will he be staying". i said a month but i think he will need longer to get sorted out. how easy/difficult would it be for him to get me out ?

It depends upon the legal nature of the occupation; licence or tenancy, excluded or included - . The rental period, would in your case be 1 week. Notice requirements -

Why dont you tell him the truth, pay him some extra rent while your brother is there,and give a firm date (and stick to it) by which your brother will be out. Otherwise, you may end up leaving what sounds like a good deal for you if you gain an extra few months by legal jiggery-pokery,and end up in somewhere much worse.

he already knows my brother is there and isnt happy about it. i just want to know what the legal position is. if he decides this evening to evict me how long would i have ?
