Chargebacks / Debit Card Fraud

Back in May I was debited £330.28 ($599) by Deerfield.com on my Abbey Visa Debit Card.

I contacted Abbey Fraud who credited my account with the amount "Pending investigation". I received the disclaimer to say I hadn't made the purchase signed this and sent it back. It stated that should Deerfield not be able to provide evidence that this was me who made the purchase I'd keep the money. Abbey also said that if Deerfield couldn't prove it was me, that was the end of it, I'd keep the money and wouldn't be contacted again.

In the mean time I had a PC look into it, who told me the IP address used (not mine as I didn't make the purchase) and the Address which was used when the order was made(which wasn't mine).

I've not heard anything, but today at the ATM noticed that Deerfield have credited me with £318.81 so at the moment I have my original £330.28 back which Abbey/Visa paid and now £318.81 from Deerfield.

A couple of questions here:

1) How were Deerfield able to credit me? the old card was stopped and the replacement has a different number

2) Will Abbey/Visa now take the £330.28 they paid back? And is this how charge backs usually work?

/me hoping that they don't notice this extra money! I'll accept this as compensation for the inconvenience and them having such a slack security system as the address they took for the order didn't match that of my Debit Card!

i think it is illegal to try to keep the money by saying nothin to no-one.. I think you need to attempt give the money back. although I wouldn't.. and i could be wrong.

I shoudn't think Abbey care which number is used for credits. You probably shouldn't be concerned either.

I have a card where the 'account' number has diverged from the card number, the discrepancy having arisen due to a replacement card being issued after some unauthorized transactions. I can (and do) credit money by referencing the account number (i.e. the original card number), but to buy things I would obviously need to quote the actual number on the card.

I wouldn't it I were you. Odds are Abbey will notice just when your account is at a low credit point - make the deduction throwing you into debt and then whalloping you with both interest and a £50 'letter charge'.

That would be the least of my worries if that happened, They have given me an interest free £1500 overdraft and I'd never use it anyway. So if it did go over that limit, some extreme fraud would have been going on to get it there.

What I cant understand though is why Deerfield have suddenly credited me with a (sightly less than previously stolen) amount.

Surely as Abbey had refunded me, Deerfield should have settled it with them? As the person I spoke to said that after investigation should there be no evidence that I made the payment nothing else would happen, not that Deerfield would re credit, then Abbey debit the amount they paid back.

They would have credited you with the original US Dollar amount, the variation in £-$ exchange rate would vary the amount credited in pounds.

I thought that could be the case, but still makes me wonder why.

Visa would have been to them for the money, and now they have also decided to pay back direct to me. Their loss around $1000

Perhaps they should stop being so incompetent when it comes to accepting payment and dealing with Chargebacks. The fact that their live support assistants had access to Debit Card numbers in plan text and freely gave out all the information regarding the order through a live chat session was also quite worrying.
