Correcting a mistake on Experian Report

To sum up quickly as I don't have much time. I have mistake on my cedit file. If contacted the finance company several tmes and they have admitted it's a mistake and promised to fix it. I've contacted experian and they have also contacted the finance company to query it. The finance company has just ignored it. I am getting ready to apply for a loan and have just being tidying up my report to make sure I get the best score possible. Experian say they can't do anything and the finance house can't be bothered.

The mistake is that I made all my payments on time and settled an agreement in August 2004. DD stopped and car went back to finance company. Then they made two further recordings between August when the account got settled and December. The first saying that I was 2 months behind and the last saying I was back upto date.

Surely somebody is responsible for making sure they submit correct data and fix any problems or are they allowed to submit what they want? I don't want to end up with a sky high rate on my new loan because of this black mark! What can I do?

IANAL but if a finance company reports inaccurate derogatory information to a credit reference agency, isn't that libel?

You can add your own notes - make sure you name the individuals you have spoken to about their mistake, let the finance company have a copy of those notes. They might just wake up.

Experian have addad a standard notice of correction saying that I dispute it and not to pay too much attention to it when making a decision. I doubt any automatic computer system will read it though.

It really annoys me as this this the only missed payment on my entire record. I've always been careful to not give them reason to record negative stuff and they have just done it anyway.

I wonder how many people are being turned down or paying higher interest rates due to errors in these reports.

My ex had a similar issue with Kay and Co. They refused to remove a record which was incorrect. We made a County Court claim of 100 for "recompense" to make the point. They didn't even bother to turn up to any hearings. In the mean time the record was amended.

Almost went to bailiff action as well due to non-payment!

Have you tried ICO (re Data Protection)

It seems if the data held about you is incorrect, and the party concerned won't fix it, ICO might be able to advise?
