Brother in Law money trouble

Hi, I'm new here and haven't yet fot as far as looking for a FAQ (if someone could point me the right way please).

I've had my Brother in Law round here for the last two hours telling all his troubles. He hasn't worked for eight months due to a boy racer pushing him off the road. Credit card and bank loan insurances are no good cos the benefit office told him he can't claim as he was self employed so go play on the motorway.

He has an arrangement with one credit card which he is paying. He has not spoken to two others. Bank loan he last spoke to in October last year when it looked like he was getting proper work but this came to nothing.

His income is now around 300 per month plus his wife is working so again he can get nothing from the benefit office.

I have told him to go the CAB and also to speak to the bank about making at least a token payment. Anything else I should tell him?

My first thought was the obvious one about persuing the matter via his car insurance, but I presume he's doing that. Even if the boy racer was uninsured he may be liable for compensation of some sort.

My second thought was that he should complain about mis-selling on his credit card and bank loan insurances. If he was self-employed he has approximately zero chance of ever claiming - especially as I'd expect this to be one the few cases where a self-employed person might be able to claim. I wonder if he's harmed his case by trying to get back to work, though.

I'd actually consider contacting a national newspaper financial advice column in this case.

There's a fantastic community of people on The Motley Fool - Dealing With Debt forum who have been there, done that, and got the t-shirt, so get him to post there along with a statement of affairs and they will guide him step by step through whatever route is best.

He is legally entitled to be placed back in the situation he was in immediately prior to the accident, or *fully* compensated. He should resist the insurer closing his claim until the medical people have said he is better or stabalised. Has he received interim payments ?

If he doesn't have legal insurance try -

- After The Event Personal Injury Claims

- Comprehensive services to people involved in car accidents where they were not to blame

- Family and motor legal insurance

- uninsured loss recovery company

- Motor Accident Solicitors' Society - No fees

He can get further help by posting full details on uk.legal and uk.legal.moderated.
