Purchasing with Credit - what will CC company do?

Hi,

I've read the consumer advice on Trading Standard's web site about the rights consumers have when purchasing using a credit card. Equal liability etc.

However, I have few questions please...

If I have since paid off the credit card statement, am I still within my rights to write to them about them being, for example, "equally liable with the trader for any breaches of contract".

What will the CC company actually do though in real life? Has anyone gone ahead with a dispute (breach of Sales of Goods Act, for example) with a credit card company, and if so did you get a satisfactory result?

The item in question cost 298 GBP and weighs 30kg. The sale was in breach of the Sales of Goods Act., and the retailer does not seem to be doing anything about my request for a partial refund (or full refund if they collect). I need other routes to raise my dispute.

Any advice or information would be appreciated.

Yes. It doesn't make any difference to your rights.

Depends on the CC Company. Halifax will generally deny responsibility. Lloyds TSB were OK last time I had to do it (about 6 years ago).

Where the goods cst 100or more and you paid with a credit card then the card issuer is liable as well as the retailer.

Credit card issuers differ. Some will simply charge the amount back to the supplier. Others will negotiate with the supplier and pressure them into accepting a retunr.

Assuming the goods really were defective the credit card company is the best route.

Out of interest, does it make any difference if the consumer has since closed that particular credit card account.. ?

Apart from the fact, I imagine a credit card company may be less willing to help as you are not a current customer..

No because the contract was still valid whilst the account was open

Willing or not, they would still be liable under the law

Thanks very much to you all for the advice and information.

I thankfully will not have to get my credit card company involved, but I will keep it in mind for the future.

The retailer in question (B&Q plc) have just phoned me today accepting full fault and will be awarding me with the compensation amount I requested.
