Unsigned Credit Agreement

Hi All

I have a finance agreement in place that I have not paid for since it commenced due to a dispute over the goods for which the agreement was made.

I have discovered that whilst I have signed the credit agreement, the finance company nor their representatives have signed it. I have the "customer copy" with my signature, not their's.

Can they enforce it ?

I would have thought that whether they can enforce it depends on whether their copy has your signature, rather than whether your copy has their signature.

For our credit agreements (cars) the signature from us comes after you have signed. You get a copy when you sign it and then another one is sent to you on execution of the agreement.

IIRC the credit agreements you get in shops for furniture dont need a second signature, you sign it amnd it becomes legal, but I may be corrected on that point.

Finally watch your credit rating, if you dont pay us in a dispute you would have to go the whole way (court and win) to get us to remove the awful credit rating you rack up by not paying.
