Disputed ATM transaction

At 17:48:49 on 06/04/2009, Big Les Wade delighted uk.legal by announcing:

No it's not. There were never any secret keys on mag stripe cards.

No they didn't.

You are not doing it right then. Call the cc company that you have a disability that make you incapable to use chip&pin, if they ask what your disability is, either make up something or ask the person at the other end whether he has any medical qualifications that enable him to make a judgment about your condition. The banks' own propaganda site states that you won't be asked to provide evidence. I have managed to get 3 chip&sig cards with relatively little trouble.

I could, but it wouldn't be enough. The CC company said they wouldn't give me my chip and sig card back unless I produced a doctor's certificate proving I had a disability.

The person on the other end of the line didn't claim any medical qualifications, she just told me to get a doctor's certificate.

Then the banks' propaganda site lied. The bank *did* ask me to provide evidence, inn the form of a doctor's certificate. When I complained to APACS, they refused to help.

In that case the obvious solution is to move to a bank that provides the service that you want. And when leaving, ensure that you inform senior management 9not the people answering the telephone) why you have gone.

It's not obvious at all. What evidence have you that such a bank exists? The one I was using (Alliance & Leicester) was able to ignore the code of practice with complete immunity from any sanctions from the industry body, why would any of the others act differently?

In fact I tried many CC companies (by accepting their offers of new card accounts). None would supply a chip and sig card.

How do I contact senior management of a bank? It's hard enough to get hold of the call centre droids.

Lloyds and Natwest have provided such cards for the asking. I just walked in (as a known customer) and asked.

I`d suggest that the fact I have such a card from Tesco, despite having no disability, would strongly suggest that such a bank does exist.

Complain and then escalate your complaint, and keep escalating it. Threaten to involve the ombudsman, this normally gets fairly senior people involved. Or do some research on the net for the very top bosses, and get in touch with them.

Ok I will take your word for it. That is interesting, and so are Mike's comments that "Lloyds and Natwest have provided such cards for the asking" (I assume he means credit cards).

Of course, things may have changed; the incident I am describing with A&L happened when C&P first came in. I will try again and see how I get on.

For Tesco, I rang up and asked for the card IIRC. I don`t recall even having to mention a disability, but this was a long time ago.

I`ve also noticed that a lot more shops are starting to train their staff in C&S cards - I`ve not been asked to wait while a manager OK`s the transaction for about 6 months now.

How long? Before the C&P switch in Feb 2006?

More likely 2007 - I had a disagreement with Halifax over a decision they made so moved all my spending onto the Tesco card, and IIRC I got it changed from C&P to C&S about the same time.

I have got chip and Sig cards (debit and credit) in the last couple of years from Egg, Cahoots, Barclays, Morgan Stanley and Abbey. I phone and say I can not read the PIN machine. True if I forget my glasses.
